Contracts and Contract Law

Contracts is an Alabama Real Estate Commission Approved Continuing Education (CE) Course exclusively for Alabama Real Estate Institute. The Contracts course is designed to target the principles of Contract Law, interpret what constitutes a contractual agreement and to identify the legally binding elements involved in a contract. In addition, explaining how to analyze a contract to determine obligations and liabilities of the involved parties.
Learning Objectives:
At the conclusion of this course the student will be able to:
- List the essential elements of a valid contract.
- Define the term contract, and know when, where, and how to properly use them.
- Define and illustrate the legal effects of contracts.
- Describe the creation of an express contract and an implied contract.
- Understand the difference between bilateral and unilateral contracts.
- Define executed or executory contracts.
- Discuss the difference between assignment and novation.
- Explain how a contract can be discharged or terminated.
- Properly use the phrase “time is of the essence” as it pertains to performance of a contract.
- Describe the rights of both parties in the event of default by either party.
- Explain and apply the proper use in various contracts used in the real estate business.
Learning Strategies:

- Dividing the class into work groups for discussing and answering quizzes; then the correct answers are given to entire class.
